Statutes of Limitations in Pennsylvania

When an individual in Pennsylvania is injured because of the negligence of another party, they may be concerned about their legal options. If the injured party does intend to bring a personal injury lawsuit against the party whose negligence caused the accident, it is important that they are aware of all requirements that must be fulfilled in order to have a successful lawsuit. In Pennsylvania, the injured party is required to meet two criteria for a successful case.

First, they must abide by the statutes of limitations that the state has implemented for civil suits. Statutes of limitations simply act as a deadline by which the individual is required to file their lawsuit against the negligent party. The statutes of limitations for various civil matters that our firm handles in Pennsylvania are as follows:

  • Personal injury cases must be filed no later than two years from the date of the accident
  • Product liability cases must be filed within two years from the date the defective product caused an injury
  • Medical malpractice cases must be filed within two years from either the date of the accident or from the time in which it became known that medical malpractice caused the issue
  • Wrongful death cases must be filed two years from the date of death
