What is premises liability?

Becoming seriously injured can have a major impact on a person for years down the road. When someone gets injured and wants to pursue a lawsuit against the responsible party, they will have to determine who owns the property that they obtained their injuries on. In the state of Pennsylvania and throughout the country, property owners are responsible for keeping their premises in a safe condition. When they become aware of an unsafe condition that exists on the property, they are responsible for taking the necessary steps to remedy the problem. For example, if there is a loose stairway banister, they should replace it so no one becomes injured while walking on the staircase. If there is a leak that can cause someone to slip and fall, it should be taken care of as soon as possible.  The owner should routinely take a look at the property to make sure that no one can become injured on the property if they should enter it. If there is a problem that the owner should have reasonably known about but didn’t, they can still be held liable because they neglected to maintain the property in a safe condition.

There are some situations in which it may be difficult to determine who owns the property that a person has been injured on. If you are injured in a store, you should immediately inform the store manager of your injury and the unsafe conditions that caused the accident to occur. If you are able to do so, you should always try to take pictures of the conditions that caused the accident in order to ensure you have proof that there was a negligent property owner when it comes time to pursue your personal injury case. It is also important to be aware of that when taking legal action against a municipality, you may be required to file a notice of claim. The statute of limitations requires that you file your accident claim within 2 years of the date of the accident, otherwise, you will not be able to bring your claim and recover damages.
